1. What's New — MCS (Amendment) Rules, 2026
Notification No. Sanini 0321/C.R.41/13C, dated 18 June 2026, inserted a new Chapter XI-B (Rules 106C-1 to 106C-14) into the Maharashtra Co-operative Societies Rules, 1961, creating a dedicated governance code for Co-operative Housing Societies, Associations of Societies and Co-operative Housing Associations. Four changes matter most in practice:
- New entity types: "Co-operative Housing Association" (2+ societies/legal bodies on one layout) and "Association of Societies" (5+ societies) are now recognised, each registered via Form Y-2 (fee Rs. 5,000).
- Membership modernised: Rule 8 now recognises Joint and Provisional members alongside Associate members. Associate membership uses new Form Y-5A; succession uses Form Y-4 (provisional membership) or Form Y-5 (family arrangement).
- Governance strengthened: Mandatory Model Bye-laws (adoptable within 3 months of publication), hybrid (video-conferencing) participation in General Body meetings, and enhanced redevelopment safeguards (see Section 4 below).
- Faster dues recovery: A dedicated summary procedure under Section 154B-29, using Form Y-6 (application) and Form Y-7 (recovery certificate), generally decided within 3 months of the first hearing.
Forms J-1, J-2 and M-1 to M-19 stand withdrawn for housing societies; a new "Y-series" (Y-1 to Y-7, including Y-5A) replaces them. Managing Committees should re-map existing compliance checklists against Rules 106C-1 to 106C-14 rather than relying on the older rule numbers.
